Title searches in settling a property is firstly to ensure that the person you are dealing with has the legal right to sell the property in the first place. Also, the details on an Offer & Acceptance form are checked for a match the details on the property’s registered title deed. The Australian Taxation office brought in new requirements for property sellers to assist with the collection of foreign resident’s tax liabilities.

DO I NEED AN ATO CLEARANCE CERTIFICATE?

Only if you sell your property for $750,000 or more.

On 1 July 2017, the requirements for all sellers are required to obtain clearance certificates prior to settlement.  Provide your settlement agent a copy of the certificate once provided by ATO.
